Every automobile insurance policy in Ontario contains no-fault accident benefits coverage. This enables the driver of a vehicle, a passenger, a bicyclist or a pedestrian to obtain benefits for injuries and losses resulting from a motor vehicle accident. Even immediate family members who were not in the vehicle can claim benefits if they can show that they have suffered psychological injury because of the accident.

No-Fault Accident Benefits
Some facts about no-fault benefits an accident victim may claim:
- You can receive a loss of income benefit equal to 70 percent of your gross income from employment, to a maximum of $400 per week.
- The income replacement benefit is payable for two years after the accident so long as you are substantially unable to perform the essential tasks of your employment. Income replacement benefits will continue to be paid after two years so long as you are suffering a complete inability to engage in any employment for which you are reasonably suited by education, training or experience.
- If you were unemployed at the time of the accident, you are not entitled to any weekly benefit for at least six months. However, if you suffer a complete inability to carry on a normal life after six months, you will become entitled to a non-earner benefit.
- If you were a caregiver at the time of the accident and are unable to carry on your caregiving activities, you may be entitled to receive the reasonable costs of paying for care to a maximum of $250 per week plus $50 for each additional child (to a maximum of $400 per week).
- Medical and rehabilitation expenses are generally limited to $50,000. If your injury is “catastrophic” as defined in the regulations, the amount of medical and rehabilitation benefits is increased to $1 million.
- Attendant care benefits are generally limited to $36,000. However, if your injury is catastrophic, available attendant care benefits increase to $1 million.
- Death benefits of $25,000 are payable to the deceased’s spouse and an additional $10,000 to each of the deceased’s dependants.
- Funeral expenses are paid to a maximum of $6,000.
